These Terms and Conditions constitute a binding contract between Customer and Seller and are referred to herein as either "Terms and Conditions" or this "Agreement". Customer accepts these Terms and Conditions by making a purchase from or placing an order with Seller or otherwise requesting products(s) or engaging Seller to perform or procure any Services. Amendments to this agreement can be made and effected by us from time to time without specific notice to you end. Agreement posted on NewAudioUnited.com reflects the latest agreement and you should carefully review the same before you use our site.
Customer understands that Seller is not the manufacturer of the Products purchased by Customer hereunder and the only warranties offered are those of the manufacturer, not Seller. All items sold by NewAudioUnited.com are Brand New and come in the original Manufacturer's Box. Warranty terms, if any, apply only to merchandise shipped to the United States or Canada. Merchandise forwarded to other International locations may not be covered under the warranty. Please check with the manufacturer or warranty provider prior to purchase, in regards to the Warranty Coverage. NewAudioUnited.com is not an authorized dealer for any of the product(s) offered. Furthermore, unless otherwise noted, NewAudioUnited.com is not affiliated with any manufacturer(s), for any of the product(s) offered. As a result, some manufacturers may deny the Warranty Coverage. However, at NewAudioUnited.com, we stand behind every product that we sell. In those extreme cases, when the manufacturer refuses to service your item during the period of the Original Limited Manufacturer's warranty, we'll step in and service the product for you, in accordance with the terms of the Original Manufacturer's Warranty, up to a maximum period of 1 year, after the purchase date (excluding any International orders, except Canada).
All International Customers are responsible for any Duties and Customs, assessed by their Country and Common Carrier. None of our fees include any Duties and Customs/or Taxes.
In purchasing the Products, Customer is relying on the manufacturer's specifications only and is not relying on any statements, specifications, photographs or other illustrations representing the Products that may be provided by Seller. Please don't rely strictly on the product information that is shown on our Website, carefully research your product, prior to making a purchase with us. We highly recommend that you conduct your product research through multiple sources. Keep in mind that all offers, promotions and prices are subject to change without notice. Customer expressly waives any claim that it may have against Seller or its Affiliates based on any product liability or infringement or alleged infringement of any patent, copyright, trade secret or other intellectual property rights (each a “Claim”) with respect to any Product and also waives any right to indemnification from Seller or its Affiliates against any such Claim made against Customer by a third party. Customer acknowledges that no employee of Seller or its Affiliates is authorized to make any representation or warranty on behalf of Seller or any of its Affiliates that is not in this Agreement.

All Multiple Product Orders are fulfilled on the first available basis only, this may result in the partial fulfillment of your Order. Seller will not be responsible for and no liability shall result to Seller or any of its Affiliates for any delays in delivery or in performance which result from any circumstances beyond Seller’s reasonable control, including, but not limited to, Product unavailability, carrier delays, delays due to fire, severe weather conditions, failure of power, labor problems, acts of war, terrorism, embargo, acts of God or acts or laws of any government or agency.
Seller reserves the right to make adjustments to pricing, Products and Service offerings without notice, for reasons including, but not limited to, changing market conditions, Product discontinuation, Product unavailability, manufacturer price changes, supplier price changes and errors in advertisements. All orders are subject to Product availability and the availability of Personnel to perform the Services. Therefore, Seller cannot guarantee that it will be able to fulfill Customer’s orders. If Services are being performed on a time and materials basis, any estimates provided by Seller are for planning purposes only. By submitting your Credit Card, you fully authorize NewAudioUnited.com to charge an additional fee of $25.00 for any Credit Card Dispute that the Customer has wrongfully initiated.
Defective or Damaged items may be returned only for a replacement, within a 7-Days period from the arrival of the product. Items returned for a replacement must be in the original condition including packaging, manuals, accessories and other documents. The Customer will be responsible for the return Shipping Charges. On the other hand, we'll cover the Shipping Charges for the replacement product(s). Prior to returning the product, the Customer must notify the Seller and obtain a Return Merchandise Authorization Number (RMA#) from NewAudioUnited.com, in writing, via E-Mail. After the 7 days period from the arrival of the product(s), absolutely no items will be accepted back, for the replacements and/or repairs. Your RMA number will be valid for 30 calendar days after it is issued. Absolutely no items will be accepted and taken back after RMA number is expired. Items that are lost and/or stolen while in transit are subject to the product replacement only. If the replacement is not available, due to the fact that the lost or stolen or item has been discontinued, a Store Credit will be issued. The 7 day period doesn't apply to any International orders. All Store Credits are valid for a period of 6 months, from the date issued. All sales for International Orders are final. Any items that were shipped in error (wrong items shipped) and/or advertised in error are subject to the product replacement. Items shipped and/or advertised in error, must be returned in the original condition including packaging, manuals, accessories and other documentation. The Customer must notify us within a 7 days period from the arrival of the product, about any items that were shipped and/or advertised in error. NewAudioUnited.com will charge a 25% restocking fee plus any applicable shipping and handling charges for any refused shipments, unauthorized returns (Unopened), non-defective returns (Unopened) or cancelled orders that have been already processed. Additional charges may apply if the item returned is not in the original condition including packaging, manuals, accessories, and other documents. Also, we'll not accept back Special Order items even if they are Unopened. All sales on Special Order items are final.
NewAudioUnited.com is not responsible for any typographical, entry and photographic errors, that may occur on our Website and in our E-Mail correspondences.
This Agreement is binding upon the parties hereto and their respective successors, heirs, legal representative and permitted assigns. In the event that any provision in this Agreement is determined to be invalid, illegal, or unenforceable, such determination shall not affect the validity and enforceability of any other remaining provisions of this Agreement.
Any dispute, controversy or difference which may arise between the parties out of, in relation to or in connection with this Agreement is hereby irrevocably submitted to the exclusive jurisdiction of the courts of New York, to the exclusion of any other courts without giving effect to its conflict of laws provisions or your actual state or country of residence. The parties hereto have expressly required that this agreement and all deeds, documents or notices relating thereto be executed in the English language.
